// TERMS OF SERVICE

1. Acceptance

By creating an account or using The Darkpool ("the Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Account

• You must be at least 16 years old to create an account.
• You are responsible for keeping your password secure. Account sharing is not permitted.
• One human, one account. You may not create multiple accounts to gain ladder, energy, or reward advantages.
• Your callsign must not impersonate other people, infringe trademarks, or include abusive or unlawful content.

3. License to play

We grant you a limited, non-exclusive, non-transferable, revocable license to access and play the Service for personal, non-commercial use, while these Terms remain in force.

4. Free to play

The Service is currently provided free of charge. We do not collect payments or financial information. If we ever introduce paid features, those will be governed by additional, clearly-disclosed terms presented before purchase.

5. Prohibited conduct

You agree NOT to:

• Reverse-engineer or decompile the server code, or attempt to extract internals beyond what is publicly served as the client
• Cheat, exploit bugs for unfair advantage, automate gameplay through scripts or external tools, or manipulate the matchmaker, ladder, or rewards
• Run load tests, scrapers, or denial-of-service attacks against our servers
• Attempt unauthorized access to other accounts or to our infrastructure
• Harass, threaten, or abuse other operators
• Submit content (callsign or otherwise) that is unlawful, obscene, defamatory, or infringes intellectual-property rights
• Use the Service in violation of EU or Lithuanian law

6. Ladder fairness

Match outcomes are computed deterministically from a server-side RNG seed and the loadouts of both operators at the moment of the exchange. We make no guarantee about specific match outcomes, ranking trajectories, reward drops, or matchmaker results. The ladder is provided for entertainment.

7. Account termination

We may suspend or terminate any account at any time if it violates these Terms or harms the Service or other operators. You may delete your own account at any time by emailing povilas.gmz@inbox.lt. On deletion, your callsign, password hash, game state, and battle history are removed, except where retention is required by law.

8. Intellectual property

The Service and all of its source code, artwork, sprites, program names, lore, and game mechanics are owned by Povilas or licensed to us. The brand "The Darkpool" and the 0xDP.0 sigil are claimed marks. You receive no ownership of any in-game asset; programs, ranks, callsigns, and other game state are revocable license grants and have no monetary value.

9. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. This does not affect any non-waivable consumer rights you may have under Lithuanian or EU law.

10. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to EUR 50. We are not liable for indirect, incidental, consequential, or punitive damages, lost profits, lost data, or service interruption. Mandatory consumer protections under Lithuanian or EU law are not affected.

11. Changes to these Terms

We may update these Terms. Material changes will be announced on the landing page or by notice in-game. Continued use after a change constitutes acceptance of the new Terms.

12. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Lithuania. Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the courts of the Republic of Lithuania, without prejudice to mandatory consumer-protection rules in your country of residence.
